WARRANTY POLICY

Warranty Effective Date: Upon substantial completion of construction work at __________________________
Luxe Development Group, LLC (“Luxe Development”) is committed to providing high-quality construction services to our clients. In furtherance of this commitment, Luxe Development provides the following warranty to the Owner of the property located at __________________________________________________ (the “Property”):

Warranty Coverage: Luxe Development warrants that all work performed on the Property will be free from defects in materials and workmanship for a period of one (1) year from the date of substantial completion of the construction work (the “Warranty Period”).

Scope of Warranty: The warranty provided by Luxe Development covers any defects that appear in the work performed by Luxe Development, including but not limited to, any defects in materials, workmanship, or construction practices.

Limitations: The warranty provided by Luxe Development does not cover: a. Normal wear and tear, including but not limited to fading or discoloration of finishes, erosion or weathering of surfaces, and similar gradual deteriorations. b. Damage resulting from abuse, neglect, alteration, improper use, or improper maintenance by the Owner or any third party. c. Damage caused by natural disasters, including but not limited to earthquakes, floods, fires, windstorms, and similar events. d. Any changes or modifications made to the Property by anyone other than Luxe Development. e. Any pre-existing conditions or defects in the Property that were not caused by Luxe Development.

Warranty Claims: To make a warranty claim, the Owner must provide written notice to Luxe Development within the Warranty Period specifying the nature of the claimed defect. Luxe Development will, within a reasonable time after receiving such notice, correct any such defect that is covered by this warranty.

Disclaimer of Implied Warranties: THIS WARRANTY IS THE ONLY WARRANTY MADE BY LUXE DEVELOPMENT AND IS IN LIEU OF ALL OTHER WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION, ANY WARRANTY OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE.

Limitation of Liability: LUXE DEVELOPMENT’S LIABILITY FOR ANY BREACH OF THIS WARRANTY OR FOR ANY DEFECTS IN THE WORK PERFORMED SHALL BE LIMITED TO THE COST OF REPAIRING OR REPLACING THE DEFECTIVE WORK. IN NO EVENT SHALL LUXE DEVELOPMENT BE LIABLE FOR ANY INCIDENTAL, CONSEQUENTIAL, OR SPECIAL DAMAGES, INCLUDING WITHOUT LIMITATION, LOST PROFITS OR DAMAGES TO THE PROPERTY.

Entire Agreement: This warranty constitutes the entire agreement between Luxe Development and the Owner with respect to the warranty of the work performed by Luxe Development and supersedes all prior or contemporaneous understandings, whether written or oral, relating to the warranty of such work.

Governing Law: This warranty shall be governed by and construed in accordance with the laws of the State of Michigan.
